Court Grants N30 Million Bail to Dele Farotimi

Prominent human rights lawyer, Dele Farotimi, has been granted bail in the sum of N30 million by a Chief Magistrates’ Court in Ado-Ekiti. The case, brought against him by the police in Ekiti State, centers around allegations of defamation involving renowned legal icon, Aare Afe Babalola.

Background of the Case

The charges stem from claims made by Aare Afe Babalola, who accused Farotimi of defaming his character in the lawyer’s recently published book, “Nigeria and Its Criminal Justice System.” The book reportedly includes statements that Babalola asserts are damaging to his reputation, prompting the defamation suit.

Bail Conditions

Presiding over the case, Magistrate Abayomi Adeosun granted bail to Farotimi under strict conditions:

1. Payment of a N30 million bail bond.

2. Provision of two responsible sureties who own property within Ekiti State.

3. Submission of his international passport to the court to restrict unauthorized travel.

4. A directive barring Farotimi from speaking to the press about the matter, whether through print or electronic media, until the case is concluded.

These conditions aim to ensure Farotimi’s compliance and prevent potential interference in the ongoing legal process.

Legal Representation

The police prosecution team was represented by Mr. Samson Osobu, while Mr. Kanbi Adejare appeared on behalf of Dele Farotimi. Both sides engaged in initial proceedings that set the stage for the trial.

The court adjourned the case to February 13, 2025, for the commencement of trial. This gives both parties time to prepare their arguments and gather necessary evidence.

The case has garnered significant attention due to the involvement of high-profile figures. It also raises critical questions about the balance between free speech and defamation laws in Nigeria, particularly in the context of Farotimi’s critique of the criminal justice system.

For now, Farotimi’s adherence to the court’s restrictions, including refraining from media commentary, will be closely monitored as the legal battle unfolds.
